SPHERING³ — ACCEPTABLE USE POLICY

Version 5.0 · Effective September 16, 2026

PLEASE READ THIS FIRST

We have no ability to audit your content. None. Your artifacts live in a vault on your device until you mint them, and after that on a permanent network that no party operates. We do not see what you mint, before or after. We do not judge your work, preview it, rate it, or decide whether it is good — because we are not in a position to, and we would not if we were. This policy is not about taste. It exists for three reasons only: some things are unlawful, some things harm other people, and some things break the machinery that everyone else relies on. Everything in it falls under one of those three.

And because a minted artifact is permanent, the moment to think about this policy is before you mint, not after. Our enforcement operates on the access we control — listing, serving, accounts. The permanent record is beyond anyone’s reach, including ours.

1 · Scope and relationship to other terms

This policy is published by SPHERING³ LLC, a Florida limited liability company, 6000 Peninsular Avenue T37, Key West, Florida 33040, United States. It applies to the Services as defined in our General Terms and Conditions and supplements those terms and our Terms of Service. If this policy conflicts with either of those documents, the General Terms and Conditions govern; this policy adds detail and does not subtract protection.

Capitalized terms not defined here have the meaning given in the General Terms and Conditions.

2 · The rule in one sentence

Use the Services lawfully, honestly, and without harming other people or the systems that serve them. The rest of this policy is that sentence in detail.

3 · Unlawful use

You must not use the Services to:

  1. violate any law, regulation, sanctions program, or court order that applies to you or to us;
  2. infringe or misappropriate any copyright, trademark, patent, trade secret, right of publicity, right of privacy, or other right of any person;
  3. engage in money laundering, terrorist financing, sanctions evasion, or any other financial crime, or structure transactions to conceal their source or purpose;
  4. export, re-export, or transfer anything in violation of export-control law; or
  5. do anything that would cause us to violate a law.

4 · Content that is prohibited

You must not submit, mint, or distribute through the Services any material that:

  1. depicts or facilitates the sexual exploitation or abuse of a minor, in any form, without exception;
  2. constitutes non-consensual intimate imagery of any person;
  3. is sexually explicit — we have no ability to verify the age of any viewer, and we do not publish a safeguard we have no means of performing;
  4. threatens, incites, or glorifies violence against a person or group;
  5. is defamatory, or discloses another person’s private information without authorization;
  6. promotes terrorism or organized criminal activity; or
  7. contains malicious code, or is designed to compromise any system.

We have no ability to review artifacts — before they are minted, or after. Every prohibition in this policy is an undertaking you give as a condition of use. It is not a promise that we check, because we have no means of checking. If prohibited material is reported to us, we act on the access we operate, as Section 7 describes. If material in categories 1 or 2 is brought to our attention we will report it to the appropriate authorities as the law requires.

5 · Fraud, impersonation, and deception

You must not:

  1. impersonate any person or entity, or misrepresent your affiliation, authority, or the origin or ownership of any artifact;
  2. represent an artifact as created by, authorized by, or associated with a person who did not create, authorize, or associate with it;
  3. mint material you know to be a copy of another person’s work as though it were original;
  4. use the Services to deceive any person into a transaction, payment, or disclosure;
  5. tamper with, forge, or misrepresent any Certificate of Authenticity, core manifest, artifact identifier, stated value, or record produced by the Services; or
  6. create an account using another person’s identity, or use the Services on behalf of a person or entity without authority to bind them.

A Certificate of Authenticity records what you declared. It is not a warranty by us that the declaration is true, and using it to make a false declaration look true is a violation of this policy.

6 · Technical abuse and system integrity

You must not:

  1. introduce malware, or interfere with the operation, security, or integrity of the Services or any network or system connected to them;
  2. probe, scan, or test the vulnerability of any system without our written authorization;
  3. bypass, disable, or defeat any rate limit, access control, Required System Precheck, Maestro One System Check, or other technical safeguard;
  4. access non-public parts of the Services, or another user’s account, vault, or data;
  5. scrape, crawl, or bulk-download the Services or their outputs except through an interface we expressly authorize for that purpose;
  6. use automated means to create accounts, submit artifacts, or perform transactions except through an interface we expressly authorize; or
  7. submit volumes or sizes of material designed to degrade the Services for others.

We publish size classes and technical limits for artifacts. Those limits are part of this policy.

7 · What we do and do not do

We do not edit your work, rewrite your descriptions, or adjust your artifacts, and we have no ability to inspect them. Enforcement under this policy begins only when a violation is reported to us or brought to us by lawful process. It is binary and operates only on the access we control: we may delist an item from our manifests, indexes and search surfaces; disable retrieval through our websites, applications and interfaces; and restrict or terminate an account. We take these steps where we reasonably believe this policy has been violated or where the law or a court requires them.

None of these steps alters a permanent record. A minted artifact lives on a network that provides no alteration mechanism to any party. Enforcement affects whether the item is discoverable and retrievable through our systems, and whether you may continue to use them — nothing more.

We may report unlawful material or activity to authorities, and we may preserve records in connection with an investigation or legal process.

8 · Reporting a violation

To report material or conduct you believe violates this policy, write to legal@sphering3.com with the artifact identifier or URL and a description of the concern. Copyright complaints follow the procedure in our DMCA Copyright Policy, not this section.

We check reports for facial compliance with this policy and act on the access we control. Because we have no ability to audit content ourselves, a report is the only way a violation reaches us. We do not adjudicate disputes between users about the merits of a work.

9 · Appeals

If we delist your material or restrict your account under this policy, we will make reasonable efforts to tell you why. You may appeal by writing to legal@sphering3.com within ninety (90) days of our notice. If you are in scope of the European Union’s Digital Services Act or a comparable regime that provides a longer period, that longer period applies — six (6) months under the Digital Services Act. We will review the appeal and tell you the outcome.

10 · Governing law

This policy is governed by the laws of the State of Florida, without regard to conflict-of-law rules. Disputes are resolved as provided in the General Terms and Conditions — in a court of competent jurisdiction in Monroe County, Florida. We do not require arbitration.

11 · Changes

We may update this policy. The version and effective date at the top of this page are authoritative. Material changes are posted before they take effect.
